On March 5th 2015 UNI Americas participated of the Congress organized by the International Confederation of Private Employment Agencies (CIETT) and its’ Brazilian representative SINDEPRESTEM. The conference delivered by UNI was about “The Capital/Labor relationship in the area of temporary workers and outsourcing services and Social Dialogue”.

UNI Americas gave a warning of the danger that the enactment of Bill 4.330 would bring to workers. This bill will be discussed again in Congress in April 2015.

During the conference, the need to further analyze outsourcing was mentioned. UNI speakers state there are two issues included in this debate. On the one hand, people who want to participate in the economic development of the country. On the other hand, workers who do no want to lose their rights and desire professional development. Trade unions consider that outsourcing, as it is currently understood, will generate a lost of rights and benefits for workers.

Business sectors were accused of using the expression “specialized services” instead of outsourcing, for the change of terminology does not bring along a change in business mentality.

As regards Social Dialogue, Regional Director of ATT, Briceida Gonzalez, made emphasis on the fact that, from the trade unions’ perspective, the basic employment form is permanent and direct. In addition, she established that a way to establish successful dialogue is by using collective bargaining agreements as a tool to exchange information, enquiries and to negotiate towards consensus.

UNI also recommended the use of Global Agreements between companies and unions to promote the enforcement of national laws and to protect workers rights. Global agreements have proven to be a useful instrument to solve conflicts between workers and employers. A clear example is the agreement that is being developed in Europe with CIETT. So far, this agreement it has shown positive results and dialogue is active due to the development of annual meetings.
